These terms govern your use of binaryox.com and any services provided by Binary OX LLC ("Binary OX," "we," "us").

Services

Binary OX provides software design and development services. The specific scope, deliverables, timeline, and fees for any engagement are defined in a separate written agreement between Binary OX and the client. In case of conflict, the signed agreement governs.

Payment terms

Fees are set out in the applicable engagement agreement and are due per the schedule stated there. Late payments may pause work until resolved.

Refund and cancellation policy

• Engagements are billed per the agreement.
• Refunds are handled case by case within 30 days of payment.
• No refund is issued for work already delivered.
• If a project is cancelled, the client pays for work completed to that date.
• For any subscription-based tools, you may cancel at any time; fees for the current billing period are not refunded.

Intellectual property

On full payment, deliverables created specifically for the client transfer to the client, unless the engagement agreement states otherwise. Binary OX retains ownership of its own pre-existing frameworks, libraries, tools, and templates.

Limitation of liability

Services are provided on a professional-effort basis. To the fullest extent permitted by law, Binary OX is not liable for indirect or consequential damages. Total liability for any claim is limited to the fees paid for the specific engagement.

Governing law

These terms are governed by the laws of the State of Arizona, USA.
